Terms of Service

1. Service Description

Atlas Suite provides a cloud-based hospitality operating system ("Service") for boutique hotel operators ("Customers"). The Service includes property management, revenue management, CRM, housekeeping, analytics, channel management, and related modules.

2. Eligibility

The Service is available to authorized hotel operators, property managers, and hospitality businesses. You must be at least 18 years old and have the legal authority to bind your organization to these terms.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use. You are responsible for all activities under your account.

4. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with the Service's operation or security
  • Upload malicious code or content
  • Resell or sublicense the Service without written consent

5. Data Ownership

Your data is yours. All operational data (reservations, guest records, financial transactions) entered into Atlas Suite remains the property of the Customer. Atlas Suite processes this data solely to provide the Service. Upon account termination, you may export your data within 30 days.

Atlas Suite's intellectual property (software, design, documentation) remains the property of Atlas Suite.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors beyond our control, including internet outages, third-party service failures, or force majeure events.

7. Payment Terms

Subscription fees are billed monthly or annually as agreed. Payments are due within 15 days of invoice. Late payments may result in service suspension after 30 days notice. All fees are exclusive of applicable taxes.

8. Termination

Either party may terminate with 30 days written notice. We may suspend or terminate accounts that violate these terms or fail to pay after notice. Upon termination, your data export window is 30 days, after which data will be permanently deleted.

9. Limitation of Liability

To the maximum extent permitted by law, Atlas Suite's total liability for any claims arising from or related to the Service shall not exceed the fees paid by the Customer in the 12 months preceding the claim. Atlas Suite is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.

10. Indemnification

You agree to indemnify Atlas Suite against claims arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

11. Governing Law

These terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved in the courts of Istanbul, Turkey, unless otherwise agreed in writing.

12. Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, pandemics, war, government actions, or infrastructure failures.

13. Modifications

We may modify these terms with 30 days advance notice. Continued use of the Service after the effective date constitutes acceptance. If you disagree with changes, you may terminate your account before the effective date.
